When it comes to her lawsuit against GTA 5 game developer/publisher, Rockstar Games and Take-Two Interactive, Lindsey Lohan just won’t give up.
Even after Rockstar Games responded to her claims, calling them “frivolous” and her reasons for filing them “only for publicity purposes,” it seems as though the actress (who is indeed no stranger to controversy) is fairly adamant about her GTA 5-related lawsuit.
For those unfamiliar with the GTA 5 and Lindsey Lohan debacle, the actress is suing GTA 5 developer, Rockstar Games, and associated game publisher, Take-Two Interactive, for allegedly using her likeness for a character, named Lacey Jonas, in the popular open-world game without her permission – even going so far as to state that Jonas is an “unequivocal point of reference.
More recently, Lohan has replaced her original 10-page complaint with a new 67-page one, with a main point of discussion being the “common interest among all celebrities, actors, singers, and athletes…to protect their likeness and personas from misappropriation by unscrupulous merchandisers.”

Lohan Still Suing Rockstar Over GTA 5
The model used in the right side of the image above is Shelby Welinder, who Rockstar used as a model for GTA 5, however, Lohan is now claiming that the company intentionally “used a look-alike model to evoke the persona and image” of herself.
Furthermore, Lohan’s lawyers have added 45 pages of pictured exhibits into her amended complaint, including the image of the blonde, bikini-clad woman above, which was featured of GTA 5‘s physical game disc.
Lohan is questionably bringing the lawsuit up in New York, whose publicity rights statute is only relevant when dealing with works of “advertising” or “trade.” However, Lohan and company are attempting to circumvent that fact by stating that Take-Two Interactive has been selling various merchandise such as coffee mugs, T-shirts, and using the above image on posters, buses, and billboards, et cetera.
In defense, Rockstar and Take-Two have raised a statute-of-limitations in regards to Lohan’s GTA 5 lawsuit, which is, according to Google, “a statute prescribing a period of limitation for the bringing of certain kinds of legal action,” in this case – a year.
However, Lohan responded by pointing that the “republication” of the red bikini-wearing blonde woman on GTA 5‘s disc satisfies an exception to the 1-year statute of limitation.
Nevertheless, it is apparent that Lohan will not let this go. It appears that her lawsuit against Rockstar and Take-Two will most likely drag on into the next year.
